1. Acceptance of Terms

Welcome to WARDEN. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and WARDEN ("we," "us," or "our") governing your access to and use of our website, products, and services.

By accessing our website, placing an order, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use our website or services.

2. Eligibility

You must be at least 18 years of age to purchase products from WARDEN. By placing an order, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into binding contracts
• You will provide accurate and complete information when placing orders
• You will comply with all applicable laws and regulations

We reserve the right to refuse service to anyone for any reason at any time.

3. Products and Pricing

3.1 Product Descriptions

We strive to display our products as accurately as possible. However, we cannot guarantee that your device's display of colors, textures, or product details will be completely accurate. All products are subject to availability.

3.2 Print-on-Demand Manufacturing

IMPORTANT: WARDEN operates on a print-on-demand business model using Printify as our fulfillment partner. This means that products are manufactured only after you place an order. Each item is custom-made specifically for you, which:

• Reduces environmental waste through sustainable production
• Ensures you receive a fresh, never-worn product
• May result in longer production and shipping times (typically 5-17 business days total)
• Limits our ability to accept returns for non-defective items (see Section 7)

3.3 Pricing

All prices are listed in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to modify prices at any time. However, prices for orders already placed will not be affected by subsequent price changes. Applicable taxes and shipping fees will be calculated and displayed at checkout.

4. Orders and Payment

4.1 Order Acceptance

Placing an order does not guarantee acceptance. We reserve the right to refuse or cancel any order for reasons including but not limited to: product availability issues, pricing errors, suspected fraudulent transactions, inability to verify customer information, or violations of these Terms. If your order is cancelled, we will notify you and issue a full refund if payment has been processed.

4.2 Payment Processing

We accept payment through Stripe, a secure third-party payment processor. Accepted payment methods include major credit cards (Visa, Mastercard, American Express), debit cards, and other payment methods supported by Stripe. By providing payment information, you authorize us to charge the payment method for the total amount of your order.

4.3 Order Confirmation

After placing an order, you will receive an email confirmation containing your order details and order number. Please review this information carefully and contact us immediately if you notice any errors.

5. Shipping and Delivery

5.1 Shipping Information

You are responsible for providing accurate shipping information. We are not responsible for orders shipped to incorrect addresses provided by you. If a package is returned due to an incorrect address, you may be responsible for additional shipping charges for reshipment.

5.2 Processing and Delivery Times

Because our products are made-to-order through Printify, processing times are longer than traditional retail:

• Production Time: 2-7 business days (time to manufacture your custom order)
• Shipping Time: 3-10 business days depending on your location
• Total Delivery Time: Typically 5-17 business days from order placement

These are estimates only. Delivery times may be affected by factors beyond our control, including carrier delays, customs processing, holidays, and weather conditions.

5.3 International Shipping

For international orders, you are responsible for all customs duties, taxes, and fees imposed by your country. These charges are not included in our prices and are your responsibility to pay.

5.4 Order Tracking

Once your order ships, you will receive a tracking number via email.

6. Intellectual Property Rights

6.1 Ownership

All content on this website, including text, graphics, logos, images, product designs, and software, is the exclusive property of WARDEN and is protected by U.S. and international copyright, trademark, and other intellectual property laws. The WARDEN name, logo, and all related product names and designs are trademarks of WARDEN.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. You may not reproduce, duplicate, copy, resell, modify, or create derivative works based on our content or designs without our written consent.

6.3 Product Designs

When you purchase a WARDEN product, you receive ownership of the physical item only. All intellectual property rights in the designs, artwork, and branding remain with WARDEN.

7. Returns, Exchanges, and Refunds

7.1 Print-on-Demand Policy

7.2 Defective or Incorrect Products

We stand behind the quality of our products. If you receive a product that is defective, damaged upon arrival, misprinted, contains manufacturing defects, or is the wrong item (our error), we will provide a free replacement or full refund at our discretion.

7.3 Claim Procedure

To report a defective or incorrect product, you must:

• Contact us within 30 days of receiving your order
• Provide your order number and detailed description of the issue
• Include clear photographs showing the defect or error
• Keep the product in its original condition (unworn and unwashed if possible)

We will review your claim and respond within 2-5 business days. If approved, we will send a replacement at no charge or issue a full refund to your original payment method.

7.4 Lost or Stolen Packages

We are not responsible for packages marked as delivered by the carrier. If your tracking shows the package was delivered but you did not receive it, please contact the shipping carrier to file a claim. While we cannot be held responsible for carrier errors or package theft, we may, at our sole discretion, offer assistance on a case-by-case basis.

7.5 Refund Processing

Approved refunds will be processed within 5-10 business days to your original payment method. Depending on your bank, it may take an additional 5-10 days for the refund to appear.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARDEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR WEBSITE OR PRODUCTS, INCLUDING ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF OUR WEBSITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless WARDEN, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms, (b) your use of our website or products, (c) your violation of any third-party rights, or (d) any false or misleading information you provide.

10. Dispute Resolution and Governing Law

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

10.2 Informal Resolution

Before filing any legal claim, you agree to contact us at support@warden.com to seek an informal resolution.

10.3 Arbitration

If we cannot resolve a dispute informally, any legal dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except that you may assert claims in small claims court if they qualify.

10.4 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action. You waive any right to participate in a class action lawsuit.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our website after changes are posted constitutes your acceptance of the modified Terms.

12. Miscellaneous Provisions

12.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12.2 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WARDEN regarding your use of our website and services.

12.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
